Section 504 of the Rehabilitation Act of 1973, is the portion of the Act, originally authorized under Public Law 93-112, that states "no otherwise qualified individual with a disability in the United States shall, solely by reason of his or her disability, be excluded from the participation in, or denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance."
Section 504 of the Rehabilitation Act is a civil rights law prohibiting discrimination on the basis of a disability. This includes all programs and activities of a school district receiving federal financial funds regardless of whether the specific program or activity involved is a direct recipient of federal funds. Local Education Agencies (LEA), like Chesterfield County Public Schools, as recipients of federal assistance, are prohibited from excluding students solely on the basis of a disability.
